INDIA SHAME! Cabinet goes against SC, clears ordinance to give relief to convicted legislators

Sending out a strong signal that the political class with the exception of a few is not ready to weed out criminal elements from amongst itself, the Union Cabinet on Tuesday cleared an ordinance that overruled a much-welcomed Supreme Court ruling that disqualified MPs, MLAs and MLCs from Parliament and Assemblies from the date of their conviction.

The ordinance comes as a huge reprieve for legislators who were facing immediate disqualification as they can continue in office despite their conviction. The ordinance comes as a reversal of the Supreme Court judgement according to which lawmakers convicted of offences with 2 years or more in jail were to be immediately disqualified. The order also barred convicted and jailed leaders from contesting elections after the court also reinterpreted the Representation of People's Act.
